Acceptance of Terms

By accessing or using the Examivate platform operated by Examivate LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our platform.

Description of Service

Examivate provides an online learning and certification preparation platform, including adaptive learning tools, practice exams, and performance analytics.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • You must provide accurate and complete registration information
  • You must be at least 16 years old to create an account
  • You may not share your account with others
  • You must notify us immediately of any unauthorized use

Acceptable Use

You agree not to use the platform for any unlawful purpose or in any way that could damage, disable, or impair the service.

  • Do not attempt to gain unauthorized access to our systems
  • Do not distribute, publish, sell, license, or reproduce exam content in any form
  • Do not use automated tools, bots, crawlers, scrapers, data mining software, or any other means to extract, harvest, or collect platform content
  • Do not copy, screenshot, record, or otherwise capture questions, answer choices, explanations, or rationales for redistribution or commercial use
  • Do not harass or harm other users
  • Do not misrepresent your identity or affiliation

Intellectual Property

All content on the platform is the exclusive property of Examivate LLC or its licensors and is protected by applicable intellectual property laws, including copyright, database rights, and trade secret law.

This includes, without limitation: practice questions, answer choices, answer keys, explanations, rationales, score reports, study materials, adaptive learning algorithms, and all content produced by or for the platform.

You may not reproduce, distribute, sell, sublicense, translate, adapt, publicly display, or create derivative works from any platform content without the prior explicit written permission of Examivate LLC.

Any unauthorized use constitutes copyright infringement and/or misappropriation of trade secrets, and will be prosecuted to the fullest extent permitted by law.

Content Protection and Enforcement

Examivate LLC actively monitors the platform and the internet for unauthorized reproduction, distribution, or use of its proprietary content. We employ technical measures — including digital watermarking, fingerprinting, and automated detection systems — to identify and attribute misappropriated content.

Any individual or entity that scrapes, harvests, reproduces, publishes, sells, or otherwise unlawfully uses Examivate's questions, answer choices, explanations, or other proprietary content will be subject to legal action.

Examivate LLC reserves the right to seek all available legal remedies, including:

  • Temporary and permanent injunctions to immediately halt unauthorized use or distribution
  • Actual damages, disgorgement of profits, and statutory damages under applicable copyright law
  • Recovery of legal fees and court costs
  • Criminal referral where applicable law provides for criminal penalties
  • Civil claims under the Computer Fraud and Abuse Act (CFAA), the Digital Millennium Copyright Act (DMCA), and equivalent laws in other jurisdictions

Content Authorship

Examivate's question bank is the product of a structured, proprietary editorial process. Each item is developed through a multi-stage workflow that includes domain research, item specification, independent multi-reviewer critique, psychometric quality checks, and final approval by a human editor.

The selection, arrangement, sequencing, editorial refinement, and curation of all questions and study materials reflect substantial human creative judgment and constitute original works of authorship protected under applicable copyright law.

The use of technology-assisted tools at any stage of the content development process does not diminish Examivate LLC's copyright in the final curated works. The originality and protectability of the content derive from the human editorial decisions governing its creation, selection, and organization.

Subscriptions and Payments

Certain features of the platform require a paid subscription. By purchasing a subscription, you agree to pay all applicable fees.

  • Prices are subject to change with reasonable notice
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Refunds are subject to our refund policy

Limitation of Liability

Examivate LLC provides the platform "as is" without warranties of any kind. We do not guarantee that our services will be uninterrupted, error-free, or that they will meet your specific requirements.

In no event shall Examivate LLC be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

Termination

We may suspend or terminate your account at our discretion if you violate these terms. Upon termination, your right to use the platform ceases immediately.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Chilean Data Protection

The processing of personal data of users located in Chile is governed by our Privacy Policy and complies with Ley N° 21.719 on the Protection of Personal Data (Chile).

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes. Continued use of the platform constitutes acceptance of the revised terms.
